Terms of service

These terms apply when your business uses telkit. They say what we deliver, and what you need in place before you send the first message.

Draft, not yet in force

This document is complete apart from the values highlighted in amber. telkit AS has to supply those before it can take effect as an agreement.

1. Parties and the agreement

These terms apply between telkit AS, registration number [to be supplied: company registration number], and the business that opens an account. The agreement consists of these terms, the price list on telkit.no, the data processing agreement, and any written addenda both parties have signed.

telkit sells to businesses. Private individuals cannot enter into this agreement.

2. The service

telkit provides SMS, telephony and transcription through one REST API with an OpenAPI contract. We hold the agreements with the carriers and sub-processors, and you call the endpoints.

We may change or retire individual features. If we remove something you depend on, we email you in advance.

3. Account and API keys

You are responsible for your keys. A leaked key gives whoever holds it access to the account. Rotate it in the console and tell support@telkit.no.

All use made with your keys counts as your use, and is billed accordingly.

4. Your responsibilities

Telephony and SMS are regulated in Norway. The duties below sit with you as the sender, not with us as the technical supplier.

  • Section 15 of the Norwegian Marketing Control Act requires consent before you send marketing by SMS, and you must be able to document that consent.
  • The sender ID must be one you are entitled to use. We block sender IDs that impersonate someone else.
  • If you record calls, you must inform participants and obtain consent. telkit provides announcements, beeps and per-number configuration, but the duty is yours.
  • Section 16 of the Norwegian numbering regulation says allocated numbers may not be offered for permanent use outside Norway without permission from Nkom.
  • You make sure your end users know about the emergency-calling limitation below.

5. Acceptable use

The service must not be used for spam, fraud, spoofed caller ID, automated dialling without consent, or content that is unlawful in Norway.

If you breach this we may stop the traffic immediately. We notify you at the same time and explain what triggered it.

6. Emergency calls

telkit does not replace ordinary telephony. We do not have full routing to 112, 110 and 113 with identity and location injection. Norwegian electronic communications regulation requires such a limitation to be disclosed, and this is that disclosure. Make sure your end users have another route to the emergency services.

7. Pricing and payment

Prices are on the pricing page and billed in euro. Voice bills per second from answer, transcription per audio second, and SMS per segment. Messages the carrier filtered out are not billed. See the price list.

This clause is missing

[to be supplied: payment terms: billing interval, due date and late-payment interest]

8. Uptime and maintenance

This clause is missing

[to be supplied: uptime commitment, or confirmation that we do not offer one yet]

Planned maintenance is announced in advance.

9. Processing of personal data

telkit is the processor for the data you send through the API, and you are the controller. A GDPR Article 28 data processing agreement is signed before production use. The privacy policy describes what we process, where it sits, and who the sub-processors are. Read the privacy policy.

10. Liability

This clause is missing

[to be supplied: limitation of liability: cap and exclusions]

Neither party is liable for circumstances outside its own control, such as a carrier outage or a loss of power and network in a data centre.

11. Term and termination

This clause is missing

[to be supplied: notice period and any minimum term]

On termination you can export your data through the API. After an agreed deadline the content is deleted, apart from data we are required to retain.

12. Changes to these terms

We may change these terms. Material changes are emailed in advance, and you may terminate the agreement if you do not accept them.

13. Governing law and venue
